Background Information Regarding
Allocations for Title III, Part A - LEP and Immigrant Education


How the Title III, Part A Allocations are Calculated:

The allocations are determined by the State Education Department based on requirements set forth in the NCLB legislation. 

The LEP allocations are based on the number of public and nonpublic LEP students served by each LEA compared to the State total. The data were collected in fall 2006 by SED's Basic Education Data System.

The Immigrant Education allocations are based on the number of immigrant students reported by each LEA to SED in spring 2007 compared to the average of the immigrant counts reported by that LEA in the spring of 2005 and 2006.  In order to receive an Immigrant Education allocation, an LEA must have experienced an increase of 10 or more immigrant students and have reported in 2006.  Each Immigrant Education allocation has a base of $20,000 plus $150 per immigrant student reported in 2007.  (This is an increase from last year's base of $15,000 plus $100 per immigrant student).

Total Amount Available for Allocation in 2007-08:  $44,731,427

This is an decrease of more than 15 percent from 2006-07. 

Less 11 percent for Immigrant Education Allocations:  $4,901,000

NCLB legislation permits SED to set aside up to 15 percent of the total amount available for Immigrant Education allocations. Last year, 8.4 percent was set aside for Immigrant Education allocations.

Amount for LEP Allocations:  $39,830,427

This amount includes $2.25 million of unused prior year funds that were available for redistribution to school districts and charter schools. The funds were redistributed using the LEP allocation formula described above.

According to statute, LEAs may only be awarded Title III, Part A LEP grants of $10,000 or more.  LEAs with allocations of less than $10,000 must apply as part of a consortium in order to be eligible for Title III, Part A funds.  (For more information, please consult Title III, Part A guidance available at http://www.emsc.nysed.gov/titlei/ca0607/titleIIIguid.htm.)
